PM: Police Decision over October 7 Crackdown Case Unconstitutional

The prime minister insists that the police commission lacks the authority to reverse the anti-graft panel's ruling in the October 7 police crackdown case, deeming it unconstitutional.

Prime Minister Abhisit Vejjajiva stated firmly that the National Police Commission, or NPC, has no power to overrule the National Anti-Corruption Commission's ruling regarding the October 7 police crackdown against the People Alliance for Democracy's demonstrators.

The commission earlier found three high-ranking police officers, who were indicted in the case, not guilty of disciplinary offenses, which is in opposition to the anti-graft panel's findings.

The three officers include Former National Police Chief Police General Patcharawat Wongsuwan, Former Metropolitan Police chief Police Lieutenant General Suchart Muenkaew and former commander of Udon Thani provincial police, Police Major General Permsak Paradornsak.

Abhisit said he has a full authority to exercise discretion over the police panel's decision and said that the issue may create legal complications.

He explained that the Supreme Court previously ruled that the Cabinet cannot seek a legal interpretation in the case, because it is not related to disputes between government organizations as is stipulated in the Constitution, and the panel is not recognized as such.

However, the premier said he does not believe that Deputy Prime Minister in charge of security affairs, Suthep Thaugsuban, who also serves as the police's panel chair, intended to violate the law.

He expressed sympathy for Suthep, who has experienced difficulties managing conflicts within the police commission.

Meanwhile, the New Politics Party's spokesperson, Suriyasai Katasila said the national police commission's decision has proven to be similar to moves by police officers under the old regime to challenge the prime minister's authority.

He commended Abhisit for strongly maintaining his principles and position, but expressed disappointment over Suthep's role on the police panel.
